大家应该都知道竞业禁止协议这么个东西，简单地说就是你离开某家公司之后，一定时间内不得在其他公司从事相关职业，更不能泄露前雇主的商业机密。
近日，上海一中院二审判决，前腾讯员工徐振华违反劳动合同中的竞业限制条款，需要向腾讯返还 1940 余万，创同类案件最高赔偿纪录。
徐振华 2009 年 4 月加入腾讯游戏，负责网游开发运营，曾研发出著名网络游戏《轩辕传奇》，并获得了腾讯的股票期权，同时签订了《保密与不竞争承诺协议书》。
徐振华 2014 年 5 月从腾讯离职，不过在 2014 年 1 月他就私下成立了自己的公司沐瞳科技，离开腾讯后又成立了两家公司，前后研发出多款游戏，都与腾讯的游戏相似，尤其是《Mobile Legends》，腾讯认为其大量抄袭了《王者荣耀》。
腾讯随即将徐振华告上法庭，索赔 2300 多万元。一审判决徐振华确实违反竞业限制约定，需向腾讯支付违约金 372 万余元，但双方均不服。
二审判决，徐振华按照双方协议约定，返还其基于腾讯授予股票获得的所有实际收益，向腾讯方面支付人民币 19403333 元。
另外，腾讯还控告沐瞳科技的《Mobile Legends》侵犯《王者荣耀》的著作权，要求游戏停止运营，并赔偿相关侵权损失。该案件将于近日开庭审理。
