任天堂的公告显示，“Maricar”公司(现株式会社MARIモビリティ开发)使用“Maricar”名号进行公路卡丁车的租赁服务，还提供马里奥COS服装的租借，对此任天堂要求被告公司停止相关知识产权侵害行为，并且赔偿损失。
东京法院认可了任天堂的起诉，被诉方“Maricar”公司须停止不正当竞争行为，并支付损害赔偿金。
MariCar公司是日本知名的卡丁车租赁公司，在没有获得授权的情况下，MariCar公司私自将印有马里奥商标的服装租给外国游客进而盈利。去年2月，任天堂向东京地方裁判所提出了要求MariCar公司赔偿1000万日元(约合60万元人民币)的诉讼。
任天堂在一份声明中说：“为了保护我们多年来通过努力工作而培育的宝贵知识产权，我们将继续采取强硬措施。”
当时MariCar对任天堂的指控提出异议。MariCar声称，根据法律专家的意见，该公司的服务并不违反竞争法或版权法。MariCar表示，该公司的代表在事前几个月前与任天堂的代表会面时，任天堂的代表也表示了对MariCar业务的理解。MariCar还表示，任天堂突然提起诉讼，导致MariCar网站因为访问量暴增而崩溃，而且公司业务受损。
其实在这场诉讼前，任天堂已经就MariCar商标侵权的问题，向日本专利厅提出了异议。不过，专利厅以“マリカー”作为“マリオカート”的简称，并未达到普遍广泛认知的程度为由，否决了此项异议。
